1.1 This Agreement is between Pro Hair Biosystems Limited (“Pro Hair Biosystems”) and you, (the "Customer") and specifies the terms and conditions of use of our websites and our commitment to your privacy.

2.0 WEBSITE INFORMATION

2.1 We make all reasonable endeavours to ensure that any information on this website is accurate and relevant. By using this website you accept that the information may on occasions, not be fully accurate, may be incomplete or out of date.

2.2 The descriptions, imagery and information provided for the products featured on this website are intended as being used for guidance only and only give a general overview of the efficacy of the products based on feedback received from users and other sources.

2.3 We take all reasonable precautions to avoid any of our computer systems becoming corrupted or infected with viruses. By using this system you accept that the company has taken all reasonable precautions to protect its computer systems and you will not hold the company liable for any viruses or other damage to your system or business. 5.2 If there is any dispute, you agree to the dispute being referred to binding arbitration for settlement.

5.3 You accept that the product has been supplied by Pro Hair Biosystems in good faith.

5.4 If any provision of these Terms and Conditions is held by a legal authority to be invalid in whole or in part, the validity of the remaining provisions of the Terms and Conditions and the remainder of the affected provision shall remain in full force and effect.

5.5 You accept that the company is insured for Public and Product Liability and the liability of the company is limited to the level of liability provided by this policy.

5.6 You accept that the liability for the product remains with the company and not with any individual.

5.7 You accept that in the event of a dispute, you will inform the company in writing and give the company 28 working days to resolve the issue to your reasonable satisfaction, before any dispute action can commence.

5.8 No third party shall have any right to enforce these Terms and Conditions, the contract is between Pro Hair Biosystems and the Customer.

5.9 This agreement is drawn up under the Laws of England and you irrevocably accept to be bound by the Laws of England and an English Court of competent jurisdiction.

Privacy Policy

1.0 GENERAL

1.1 When you purchase a product online we require your name, address, postal code, telephone number, email address. We may also require your credit card details, depending on the method or payment you choose.

1.2 We retain all of your personal details on file but will not retain your credit card or other financial details. These will be re-entered each time you make a purchase.

1.3 We will use the information provided to us to keep you informed of the status of shipping of your order, your invoice and invoicing details, reminders when your product is likely to require renewing and marketing information, unless you inform us that this is not required.

1.4 We never share any information you provide to us with any third party.

1.5 We only use cookies to enhance your experience on our site.

1.6 Information is stored in a secure database for use only by Pro Hair Biosystems and their staff on a need-to-know basis.

Pro Hair Biosystems Terms and Conditions for Product Purchases

1.0 GENERAL

1.1 This Agreement is between Pro Hair Biosystems Limited (“Pro Hair Biosystems”) and you, (the "Customer") and specifies the terms and conditions for product purchases from Pro Hair Biosystems and its websites.

2.0 PRODUCT PURCHASES

2.1 When you submit your order with valid credit card details, we aim to process and despatch your order as soon as possible, due to the system involved it is impossible to cancel an order once placed, but this does not affect your right to return the product for a full refund once it has been received by you (excluding the cost of postage and packing). Please allow 14 days for delivery, however typically items are dispatched within 2 working days, and should arrive within another 2 days.

2.2 Our website gives an indication of product availability, however products may occasionally be out of stock. If a product is out of stock, we will inform you as soon as practicable. You will be informed when the product is due back in stock and you will be given the choice of waiting for the order or cancelling your order.

2.3 Pro Hair Biosystems uses Credit Card module provided by Protex and Google Checkout for secure payment collection services and their Terms and Conditions apply to the processing of transactions.

3.0 POSTAGE AND PACKAGING

3.1 We will normally send your goods within 48 hours of purchase and will dispatch it to UK addresses using Royal Mail. If you have not received your order within 14 days from your purchase date, or it is received damaged or incorrect in any other way, please contact us in the first instance using our contact form, quoting your order number

3.2 Registered customers can check the status of their order by logging in to their account.

3.3 You are responsible for providing us with correct information to enable us to mail your order to the correct address. If an order cannot be dispatched or is mailed to an incorrect address due to incorrect information being provided by you, then this remains your responsibility.

3.4 If a product is sent via Special or Recorded Delivery and this requires a signature to confirm delivery, this is your responsibility, including collecting the package from the post office or sorting office if there is no-one at the address to collect the parcel.

4.0 WARRANTY

4.1 We want you to be delighted with your purchase from Pro Hair Biosystems. Our business depends upon customer satisfaction and loyalty to continue. However, should you so wish, you can return any unused and unopened item purchased from us for any reason within ninety (90) days of your purchase and your full cost of purchase, excluding postage and packing will be refunded to you within 10 days of being received.

4.1.1 Returns Procedure: You must request a returns-number by quoting your order-number using our contact form. You will then be able to return the product, to the returns-address provided, quoting your returns-number.

4.1.2 Additionally, you may return part-used products if you are dissatisfied with them for any reason whilst trialling your first purchase. In addition to the above returns procedure we also ask that you complete a questionnaire, provide a photograph and give an explanation of why you wish to return the product.

4.2 We will refund purchases made within the previous three months and will accept the reasons given by you. We offer a no-quibble guarantee. We do not refund postage and packing costs. If you have taken advantage of free or included postage, your refund will be the purchase price less the indicative postage price shown in the product description page.

4.3 You can buy products from us again, even though you have returned previous products for a refund, but only one refund is permitted per household.

4.4 A refund will be made within 10 days of your goods being received by us.

4.5 ProFusion™ products are recorded with the Department of Business, Enterprise and Regulatory Reform under the cosmetics and toiletries regulations and no medical or therapeutic claims for the product are made or implied. If your hair loss is due to an illness you must consult your doctor, similarly if you have any concerns about using ProFusion products while taking or using any medication or while suffering from any medical complaint, you should consult your doctor.

4.6 For the avoidance of doubt, Pro Hair Biosystems does not warrant that your hair will regrow.

5.0 CONTRIBUTION TO RESEARCH

5.1 5% of receipts from sales of Profusion™ products, excluding Postage, Packing and Handling, will be deposited in a dedicated account annually. This will be used to fund research from independent academic institutions into hair loss and further methods of retarding hair loss.

5.2 Contributions will accumulate in the dedicated account until such times as it has reached a level sufficient to contribute to the research. Details of which academic institution is carrying out the research will be published on the website.

5.3 Information obtained will be used for the benefit of registered customers of Pro Hair Biosystems.

5.4 Funding for research may be made independently or in conjunction with 3rd party Government funding which may or may not be available at that time.
